Terms of Service
Draft. Not legal advice. Pending approval by Jeanne-Michael du Plessis, Duplessis Innovations. Version 0.1 draft, last updated 24 September 2026. This page adapts that draft: it does not name a school and it does not state a price. Pricing is agreed with the school. It is not in force until it is approved.

1. Parties and the service#
These terms are between Duplessis Innovations (Pty) Ltd (Cape Town, South Africa) and:
- the school that uses GuardianLink, and
- staff and parents or guardians who sign in to the app or the school portal
GuardianLink is a multi-tenant communications tool. Teachers record the school day. Linked parents read released daily reports. Principals manage enrolment and review on the school portal.
GuardianLink is not an emergency service, not a medical device, and not medical or clinical advice. It does not replace talking to staff at the door, calling the school, or contacting emergency services. Child safety decisions stay with the school and the family.
2. The current service#
- Contact us for pricing. Prices are agreed with the school and are not published on this website.
- There is no checkout in the product in this version.
- Duplessis Innovations may change, pause, or end a school’s access with notice to the school.
- Push notifications and phone one-time-password sign-in are not part of the current service.
- Support is by email: hello@duplessisinnovations.com
If pricing changes, new terms will be agreed in writing. These draft terms do not by themselves create a paid licence.
3. School responsibilities#
The school is the responsible party for personal information it enters into GuardianLink (see the Privacy Policy). The school must:
- Have a lawful basis under POPIA, and any other law that applies, before uploading information about children, parents, or staff, including consent from a parent or guardian where that is required, especially for information about children and special personal information
- Keep enrolment accurate: the right children, families, and class allocations
- Control staff access: invite only people who should have access, and revoke access the same day someone leaves or changes role
- Train staff not to use GuardianLink for anything other than lawful childcare communication
- Tell parents that daily reports are written by staff and may be incomplete
- Not rely on GuardianLink as the only way to share an urgent concern, such as an injury, an allergy event, or a missing child
Duplessis Innovations is the operator. We run the software. We do not take over the school’s duty of care.
4. Accounts and acceptable use#
- Staff and parents must keep login details confidential and sign out on shared devices
- Use GuardianLink only for lawful school–family communication
- Do not attempt to view another school’s tenant, scrape the service, probe other accounts, or upload false or harassing “concerning” patterns
- Do not use the service to send spam, malware, or content that is unlawful
- Children must not be given their own logins
We may suspend an account that we reasonably believe is being abused, and we will tell the school when we do.
5. Parent terms#
- Parents sign in with the login the school has linked to them, using an email code. A password is only a fallback where one already exists
- Parents may view released reports for linked children only, leave an optional remark, and see that a first view was recorded
- Parents cannot edit the school’s care records
- Reports reflect what staff typed. If something looks wrong, contact the school first
- Open the app to see today’s report. Push delivery is not part of the current service
6. Staff terms#
- Teachers and assistant teachers capture and check out children allocated to them
- Principals and admin assistants use the school portal for enrolment and operations, and a lighter roll and acknowledge view in the app
- A day marked concerning is held back from parents until a principal or admin assistant acknowledges it. That is a communication control, not a clinical review
- There is no school-device PIN login in this version
7. Availability and no warranty#
The service is provided as is and as available. We aim to keep it up, and we do not promise uninterrupted access, error-free software, or that a report will be delivered at a particular time.
We are not responsible for:
- staff or parent devices, school Wi-Fi, or mobile networks
- content staff or parents type
- a parent not opening the app
- delays while a concerning day waits for acknowledgement
8. Liability#
To the fullest extent South African law allows:
- Duplessis Innovations is not liable for childcare, medical, or emergency decisions made by the school or a family
- We are not liable for indirect or consequential loss, including loss of profit, reputation, or data that the school can recreate from its own paper records
- Our total liability to the school arising out of the service is limited to the fees the school has actually paid for GuardianLink. Where no fee has been paid, this draft sets that cap at zero, or if a court will not accept a zero cap, to the minimum amount the law requires
- Nothing in these terms limits liability that cannot legally be limited, for example fraud or gross negligence where the law so provides
The school remains responsible for child safety and for the accuracy of what its staff record.
9. Termination and data export#
- Either the school or Duplessis Innovations may end use on written notice. Email is enough
- We may end access immediately for abuse, a security risk, or a legal requirement
- After the school asks in writing, we will provide a reasonable export of that school’s GuardianLink records, for example a database dump or CSV of children, reports, and entries, within 30 days
- After export, or if the school does not want a copy, we will delete or de-identify that school’s tenant data according to the Privacy Policy, except records we must keep by law
Parents who leave the school should ask the school about their child’s records. Parent app access follows the school’s enrolment.
10. Privacy#
The Privacy Policy explains what we process and why. A formal operator agreement may be attached once counsel has reviewed it. Until then, the Privacy Policy describes the intended split: the school as responsible party, Duplessis Innovations as operator.
11. Governing law#
These terms are governed by the law of the Republic of South Africa. The courts of South Africa have jurisdiction, with a preference for courts in the Western Cape.
